Ida Pod’s Terms and Conditions
The following contract and its terms will set forth an agreement between the ‘Company” and the “Client” for the hire of the Ida Pod Photo Booth. This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.
1.1 The “Client” means the person/s, organisation or company booking the equipment, act or entertainment with the “Company”. 1.2 The “Provider” meaning Ida Pod Limited. 1.3 ‘The Ida Pod’ the actual Photo Booth 1.4 ‘Wet’ hire is the hire of equipment or entertainment accompanied by a representative of the ‘company’ to supervise use of the booked equipment or entertainment.
All equipment remains the property of the ‘Provider’ at all times.
By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.
In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfill our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
Prices, Deposit & Balance Payments
All hires are subject to a deposit of at least 50%. Until a deposit or full payment is made, the booking date cannot be confirmed. (Deposit is non refundable).
The balance to be paid in full and cleared at least 28 days prior to the event start date. If your event commences within this time span i.e 14 days prior you will need to clear funds in order to secure the date.
Advertised prices are subject to change without prior notification.
An idle fee can be negotiated on extensive waiting times but the ‘Client’ has the 1 hour each side to allow the Company to assemble and dissemble the booth.
3.5. The ‘Client’ will be subjected to ‘Idle Time’ prices if your event is paid been up until your time and we are restricted and or it is not safe for us the ‘Provider’ to remove our equipment and break down *Prices are available on website* i.e if we are prevented from breaking down due to where we are placed or set up/ not enough light to break down safely/not enough power to shut down/restrictions to getting to vehicle etc. fee will need to be added.
3.6. A a d d i t i o n a l ‘ Holding Deposit’ fee of £100.00 may be added to high risk events or If the unit needs to remain onsite overnight and to be be fully refundable post event/ 2 working days Maximum period.
4.1 Any cancelled order is subject to the following cancellation charges Within 28 days of scheduled hire date there will be no refund Outside of 28 days of scheduled hire date, the deposit will be forfeited.
5.1 The ‘Client’ acknowledges that it shall be responsible for any damage or loss to Ida Pod’s Company equipment caused by any misuse of our equipment by its customers or its guests or any theft or disaster (including but not limited to fire or flooding) at the clients event, other than damage or loss arising from negligence or willful default of the Company or its representatives.
The ‘Provider” will require a workspace of 9ft (W) x 6ft (D) x 7ft (H). The ‘Client’ will be responsible for providing suitable space as well as providing a standard working plug socket for power to the hired booth.
The ‘Provider’ reserves the right to amend or alter any product specifications with prior notice.
‘The Client’ will be held responsible if we loose more that 50% of our Props due to theft, clear damages or severe misuse and the fee of £30.00 will be invoice after the event in these instances to cover P&P and replacements we make allowances for general wear and tear
Site Location, Facilities & Conduct
Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
The ‘Provider’ reserves the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the ‘Provider’ of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.
The ‘Client’ is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.
The ‘Provider’ reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company reasonably feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.
Liability & Insurance
The ‘Provider’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company).
The ‘Client’ agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire caused by the Client’s employees, up to a maximum value of £3,000.00
The ‘Company’ accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
Use of Images for Possible Marketing Purposes
8.1 The ‘Client’ understands Ida Pod Limited the ‘Provider’ owns the rights to all images taken at worked on events for internal / general marketing, advertising and promotional purposes.
8.2 The ‘Provider’ r e s e r v e s t h e r i g h t t o r e m o v e any images that are deemed unsuitable o r p r o f o u n d i n a n y a c t i o n d u r i n g a n y v i s i t s i n o r d e r t o p r o t e c t t h e c l i e n t a n d t h e i r c o m p a n y r e p u t a t i o n ; ( n u d i t y , d r u g u s e , s e x u a l a c t i v i t y e t c . ) The ‘Company’ will and can consider removing an images that cause embarrassment or distress within reason
8.3 Please Tick here if you as the ‘Client’ would prefer to NOT to have your images used for any Marketing The ‘Provider’
Hiring, Delivery and Service
Delivery, set up and removal of the equipment are free and including in the total amount paid.
Time taken to deliver, set up and remove the equipment will be outside the rental period.
A fully presentable, well groomed trained representative of the ‘Company’ will be on site throughout the hire of the equipment to ensure smooth running.
9.4 Our on site Assistants are not Nannies and take no responsibility for the action of Children the Parents are. The reserve the right to refuse entry to the units to any guest deemed unsuitable.
A 50% deposit is required at the time of booking a photo booth, the remaining balance is due 7 days prior to your event. If the operator uses the equipment for a time period in excess of the service period agreed to overleaf, the overage in rental time will be billed to the operator at the following rates: £100 per hour. Idle hours are charged at £25 per hour.
Payment for any overtime must be paid before additional hours are provided.
‘Client is responsible for supplying the Power source for the
LATE Payment Terms added to all contracts, therefore if for whatever reason if payment is not paid post event additional late payment fee will be owed- – able. ( T i m e S p a n 7 d a y s p o s t e v e n t u n a u t h o r i z e d ) The ‘Company’ will charge payment terms fees of 11% of the final balance owed. By reading this you are agreeing to abide.
DATE CHANGES & CANCELLATIONS
Any request for a date change must be made in writing/email contact at least 30 days in advance of the original event date. Change is subject to the booth’s availability and receipt of a new booking contract.
If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled.
Any cancellations will forfeit any deposit payment made your deposit is non refundable however we will move your hire date
We will not store any credit or debit card details.
